How Rideshare Insurance Works
Uber and Lyft provide different levels of insurance coverage depending on the driver’s status at the time of the accident:
App Off
When the driver’s rideshare app is turned off, only the driver’s personal auto insurance applies. Uber and Lyft provide no coverage.
App On, Waiting for a Ride Request
When the driver has the app on but has not accepted a ride, Uber and Lyft provide limited liability coverage, typically $50,000 per person / $100,000 per accident for bodily injury and $25,000 for property damage.
En Route to Pick Up or During a Trip
Once the driver accepts a ride request and throughout the trip, Uber and Lyft provide $1 million in third-party liability coverage and $1 million in uninsured/underinsured motorist coverage. This is the highest level of coverage available.
Types of Rideshare Accident Claims
Our firm handles all types of rideshare accident cases, including claims by rideshare passengers injured during a trip, claims by other drivers or pedestrians hit by a rideshare driver, claims by rideshare drivers injured by other motorists, accidents involving rideshare vehicles picking up or dropping off passengers in traffic lanes, and multi-vehicle rideshare accidents.
Frequently Asked Questions
Can I sue Uber or Lyft directly?
Uber and Lyft classify their drivers as independent contractors, which limits direct liability. However, our attorneys pursue claims against the rideshare company’s insurance policies, which provide up to $1 million in coverage during active trips.
What if the rideshare driver was at fault?
If the rideshare driver caused the accident, you can file a claim against both the driver’s personal insurance and the rideshare company’s commercial policy, depending on the driver’s status at the time.
