Understanding the IRE in Pennsylvania Workers’ Comp

The Impairment Rating Evaluation is the single most impactful event in many PA workers’ comp cases. Here’s how it works — and how we challenge it.

The Detail

At 104 weeks of total disability, the PA insurer can request an IRE. A rating below 35% whole-person impairment converts your status from total to partial, capping wage benefits at 500 additional weeks. The IRE examiner, the use of the AMA Guides, and the inclusion of all impairments are all contestable.

What This Means for Your Case

Every workers’ compensation case turns on the specific facts and the specific state’s law. The general principles in this post apply across Pennsylvania, New Jersey, New York, and Maryland, but the deadlines, procedures, and benefit formulas differ in important ways state to state.
